Abstract: У статті показано роль суб’єктивних факторів під час практичної діяльності судового експерта. Автором запропоновано шляхи зменшення впливу суб’єктивних факторів на формування внутрішнього переконання судового експерта. Надані пропозиції щодо підвищення якості судових експертиз.
В статье показана роль субъективных факторов при осуществлении практической деятельности судебного эксперта. Автором предложены пути уменьшения влияния субъективных факторов на формирование внутреннего убеждения судебного эксперта. Даны предложения относительно повышения качества судебных экспертиз.
Description: The article shows the role of subjective factors in the implementation of practical activities of a forensic expert. Author offered ways of reducing of the influence of human factors on the formation of internal belief of forensic expert and gave suggestion to upgrading of quality of forensic examinations. Forensic expert reports are the source of proofs, its must be objective and only faithful. However, in practice at research of the same objects with unchanging signs different forensic experts under influence of human factors on the basis of the internal beliefs sometimes formulate opposite conclusions. The erroneous reports of forensic expert in most cases are reason for erroneous court decisions. Influence of human factors is especially great at identification researches of little informing objects (for example, signatures) within the framework of traditional criminalistic examinations and examination of objects of intellectual property. Using in judicial practice methods of mathematical processing of results of research will allow to reduce the influence of subjective factors on the formation of the inner conviction of the forensic expert. All expert’s techniques have to be improved by addition of simple methods of the mathematical analysis at stages of separate and comparative research, and also it is necessary to give examples of expert opinions (depending on results of these calculations). Also is necessary a development of methodical recommendations for judges on questions of estimation of the conclusions of forensic expert, set forth as establishment of degree of coincidence of signs of the compared objects and research results got with the use of methods of mathematic. Forensic experts studies on different fields, their retraining and re-certification are desirable to conduct on the basis of higher education institutions with the participation of forensic experts experience. All forensic experts should be involved in research work in their specialty, systematically acquainted with new literature and developments in related areas of knowledge, to use international experience of the forensic examinations.
