| Abstract: | Конвенция о защите прав человека и основных свобод рассматривается в качестве ключевого международного договора, с которым, начиная со II половины XX в. и до наших дней, связано сохранение европейских идеалов прав человека и демократии. Обращается внимание на международно-правовые способы влияния Конвенции на сохранение и укрепление политико-правовой идентичности Европы. Показаны основные направления, по которым происходило и происходит ее влияние на правовую систему Украины, а также основные различия, сохраняющие между национальным и конвенционным правопорядками. |
| Description: | European Convention on Human Rights and Fundamental Freedoms is considered to be the key international treaty which since the beginning of the second half of the twentieth century and up to now has been associated with maintaining European ideals of human rights and democracy. The international legal ways of the Convention influence on maintaining and strengthening political and legal identity of Europe are emphasized. The key directions of influence of the Convention on the legal system of Ukraine, the major differences between national and conventional law and order are also presented in the work. |
